These Terms of Use (the “Terms”) apply to the Glitchord website and mobile application (together, the “Service”). The Service is operated by James Muscat-Sharp (“we”, “us”, or “our”).

1. Acceptance of these Terms
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you use Glitchord on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.
2. About Glitchord
Glitchord is a guitar and music-learning and reference application. It provides tools and information for exploring chords, scales, progressions, tunings, fretboard relationships, and related musical concepts. It is intended to support learning and creative work, not to replace professional instruction or your own musical judgement.
3. Your permission to use the Service
Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, and revocable permission to use the proprietary parts of the Service on devices you own or control for personal, educational, and musical purposes. Any app-store terms that apply to your download or device also continue to apply.
4. Intellectual property
The proprietary application—including its software, interface, design, branding, visual assets, written material, and original organisation and presentation—is owned by or licensed to us and is protected by applicable intellectual-property laws. General musical concepts, chord names, and music-theory principles are not claimed as our property.
These Terms do not transfer ownership of the Service or grant permission to use Glitchord names, logos, or branding. The separate licences described below continue to govern their identified components.
5. Open-source and third-party components
Glitchord includes or uses separately licensed open-source, third-party, and public-domain material. Those components are governed by their own licence terms. If these Terms conflict with an applicable third-party licence, that licence controls for the relevant component. Restrictions in these Terms do not reduce rights granted directly under such a licence.
The applicable notices, including information about the Artistic-2.0 ChordPro-derived component, are available on the standalone licences page at /licenses. No upstream project is represented as sponsoring or endorsing Glitchord.
6. Musical information and your responsibility
Glitchord aims to provide useful and accurate musical information, but musical naming, analysis, voicing, fingering, and interpretation can vary with tuning, instrument, arrangement, physical technique, and context. We do not guarantee that every interpretation, fingering, suggestion, or recommendation will be complete, error-free, comfortable, safe, or suitable for every player or use.
You are responsible for deciding how to use the information in practice, teaching, composition, recording, performance, or other musical activity. Stop playing and seek appropriate advice if an exercise or fingering causes pain or discomfort.
7. Your content and shared features
Some features may let you save or share items such as progressions, tunings, chord collections, or notes. You retain any rights you already hold in content you create. You give us and our service providers permission to host, copy, process, and display that content only as needed to provide, secure, and support the feature you choose to use.
You are responsible for your content and must have the rights needed to use and share it. Do not submit unlawful, infringing, harmful, or confidential material that you are not authorised to share. Content shared in a collaborative area may be visible to its other members.
8. Prohibited misuse
You must not:
- use the Service unlawfully or infringe another person's rights;
- interfere with, damage, overload, or bypass the security of the Service;
- introduce malicious code or attempt unauthorised access;
- scrape, extract, or reproduce a substantial part of proprietary Service content or databases for a competing product; or
- copy, modify, reverse engineer, resell, or redistribute proprietary parts of the Service except where the law or an applicable third-party licence permits it.
9. Availability and changes
We may update, improve, change, suspend, or discontinue features. We do not promise that the Service will always be available, uninterrupted, compatible with every device, or free from errors. Where reasonably practical, we will try to give appropriate notice of a material change that adversely affects an active paid service.
10. Third-party platforms and services
Features such as app distribution, Google sign-in, cloud storage, or external links may involve third-party platforms. Their own terms and privacy policies apply to their services. We are not responsible for third-party services outside our control, although this does not affect any responsibility we cannot lawfully exclude.
11. Disclaimer of warranties
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we do not promise that it will meet every requirement, always be available, or be completely accurate or error-free. Nothing in these Terms excludes any guarantee, warranty, or consumer right that cannot lawfully be excluded.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect or consequential losses that were not reasonably foreseeable when you agreed to these Terms, or for loss caused by matters outside our reasonable control. We are not responsible for musical, performance, teaching, or creative decisions you make in reliance on reference information where we have used reasonable care.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of rights that cannot lawfully be excluded, or any other liability that the law does not permit us to exclude or limit. If you are a consumer, your mandatory statutory rights remain unaffected.
13. Suspension and ending use
You may stop using Glitchord at any time. We may suspend or end access to an account or network feature where reasonably necessary because of a serious or repeated breach, security risk, unlawful conduct, or harm to the Service or other users. Where appropriate, we will give notice and a reasonable opportunity to remedy the issue.
Terms which by their nature should continue after use ends—including ownership, licence carve-outs, disclaimers, and liability provisions—will continue to apply.
14. Governing law and jurisdiction
These Terms and any dispute relating to them are governed by the laws of England and Wales, subject to any mandatory consumer protections and rights to bring proceedings in your country of residence that cannot be excluded by agreement.
15. Changes to these Terms
We may update these Terms to reflect changes to the Service, law, or business. The latest version and its update date will be published here. If a change is material, we will take reasonable steps to provide notice before it takes effect where required. Continuing to use the Service after the effective date means the updated Terms apply, subject to your rights under applicable law.
16. General
If a provision of these Terms is found unenforceable, the remaining provisions continue in effect. A delay in enforcing a right is not a waiver of that right. These Terms do not give enforcement rights to a person who is not a party to them, except where applicable law provides otherwise.
